• Information and Conveyance are provided using GPS device under instructions of Delhi Government.
• DIMTS does not give guarantee of:
• Conduct of driver
• Response of driver
• Condition of auto
• Safety during travel
• Fare of the journey
• Correctness of phone numbers (while all efforts are made to do so)
• Updating of phone numbers by auto drivers
• 24/7 service of the application
• Presence of other autos not appearing on the application. This cannot be held as evidence against any issue.
• This service is for your convenience and you agree voluntarily to use it.
Quotes and Payment
• The customer shall pay the sum of the following:
• The fare as per fare-meter or as per fixed fare agreed, whichever is applicable.
• The toll charges payable by the customer only when crossing the toll post.
• Additional night surcharge whenever applicable.
• Any fee or levy presently payable or hereinafter imposed by the law or required to be paid for availing of the auto services.
Variations
The Customer agrees and acknowledges that the use of the services is at the sole risk of the Customer and that DIMTS disclaims all representations and warranties of any kind, whether express or implied as to condition, suitability, quality, merchantability and fitness for any purposes are excluded to the fullest extent permitted by law.
Without prejudice to the above, DIMTS makes no representation or warranty that:
• The service will meet your requirements
• The service will be uninterrupted, timely, secure, or error-free.
• DIMTS shall be entitled to add, vary or amend any or all these terms and conditions at any time and the customer shall be bound by such addition, variation or amendment once such addition, variation or amendment are incorporated into these terms and conditions.
Liability
• DIMTS shall not be responsible or liable for any loss or damage, howsoever caused or suffered by the customer arising out of the use of auto service offered through Poochh-O App.
• DIMTS shall not be responsible or liable for the failure of Poochh-O App to provide services to the customer for any reason whatsoever including but not limited to the customer\'s non-compliance with the services, malfunction, partial or total failure of any network terminal, data processing system or other circumstances whether or not beyond the control of DIMTS or any person or any organization involved in the above mentioned systems.
• Without prejudice to the above, DIMTS shall not be liable for any direct or indirect loss or damage which may be suffered by the customer as a result of any failure by Poochh-O App to provide an auto service to the customer within any stipulated time even after confirmation of booking by the auto driver.
• Customer shall indemnify DIMTS from and against and in respect of any or all liabilities, losses, charges and expenses (including legal fees and costs on a full indemnify basis) claims, demands, actions and proceedings which DIMTS may incur or sustain directly or indirectly from or by any reason of or in relation to the use or purposed use of the services by the customer and shall pay such sums on demand.

• All vehicles registered with DIMTS are continuously tracked using GPS for security reasons only.
• DIMTS encourages all of its customers to take full responsibility of his/her items.
• DIMTS is not responsible for any loss or damaged item of the customer inside the auto/bus during journey.
• If the commuter leaves any goods in the vehicle then DIMTS will not be able to take up the issue in any form like complaint/feedback.
• The courts of Delhi, India shall have the sole and exclusive jurisdiction in respect of any matters arising from the use of the services offered by DIMTS or arrangement between Poochh-O App and the customer.
